The Rise of the 'Fair and Reasonable Offer': Alberta Human Rights Tribunal sees an Uptick in Dismissals

Tribunal Dismisses Complaint After Fair and Reasonable Offer Rejected

In a recent case out of the Alberta Human Rights Tribunal, Silva v Stock Transportation Ltd., 2026 AHRC 60, the Tribunal dismissed a complaint after the complainant rejected a settlement offer of $10,000 in general damages and human rights training for members of the employer's staff. The Tribunal found the offer to be fair and reasonable, and dismissed the complaint in its entirety pursuant to section 26 of the Alberta Human Rights Act. 
 
In reaching its decision, the Tribunal considered the range of damages awarded in comparable cases and undertook a limited assessment of the merits and risks of the complaint.

What Makes a Settlement Offer “Fair and Reasonable”?

To be considered “fair and reasonable”, an offer need not be the highest award a complainant may be awarded at the Tribunal, include all the remedies sought by the complainant, or require the respondent to accept liability.
 
If the settlement offer meaningfully addresses both the complainant’s harm and the broader public interest, a well‑crafted offer—even at the lower end of the typical damages range—can resolve a complaint without a hearing. 

Why This Decision Matters

Early resolution is a central feature of the Alberta Human Rights Act.
 
Silva joins a growing line of cases (including Ntaisi, Pitstra, and Okeke) that confirm a fair and reasonable settlement offer must be treated seriously, and complainants who decline such offers risk having their complaint dismissed.
